I. General Requirements (1) Guiding ideology Guided by Socialism with Chinese characteristics Thought of the Supreme Leader in the New Era, we will resolutely implement the work arrangements of the plenary session of the municipal party committee and district committee to deepen urban renewal and promote high-quality development, adhere to the leadership of the party, adhere to the guidance of party building, and strengthen the leadership, organization, overall planning and supervision role of grassroots party organizations in standardizing the work of openly introducing cooperative enterprises and cooperative enterprises in the renovation and reconstruction projects of old villages in our district, so as to ensure the smooth progress of the renovation of old villages. (II) Basic Principles 1. The principle of fully respecting villagers’ wishes and decision-making power. 2. The principles of openness, fairness, justice, honesty and credibility.3. The principle of comprehensive consideration and selection based on factors such as development ability, financial strength, performance experience, industrial introduction, urban service and tax contribution to the local area. 4. The basic data survey of old village reconstruction is organized by the government, and a certain number of members’ representatives are invited to participate. Old villages that introduce cooperative intention enterprises should stipulate in the cooperative intention agreement that cooperative intention enterprises shall not conduct basic data surveys on their own. 5. After the district government publishes the basic data, the village collective economic organizations can introduce cooperative enterprises. (III) Scope of Application These work guidelines apply to cooperative enterprises or cooperative enterprises that are openly introduced into cooperative transformation projects of old villages within their respective administrative areas. Choose to transform the old village independently, and the village collective economic organization shall not transfer the equity in principle; The transfer of equity shall be regarded as cooperative transformation and shall be implemented in accordance with the relevant provisions of these work guidelines. In addition to the cooperative transformation projects of old villages that have been approved and substantially promoted before the issuance of the Notice on Printing and Distributing the Relevant Procedures for Further Standardizing the Reconstruction of Villages in Cities (Sui Jiu Gai Ban [2011] No.51), cooperative enterprises have been selected according to Article 25 of the Implementation Measures for the Renewal of Old Villages in Guangzhou (Order No.134 of Guangzhou Municipal People’s Government) before January 19, 2018. And before the issuance of this guideline, it has been in accordance with the Notice of Guangzhou Urban Renewal Bureau on Printing and Distributing the Opinions on Further Standardizing the Relevant Matters Concerning the Selection of Cooperative Enterprises for Cooperative Renovation Projects in Old Villages (Sui Xin Gui Zi [2018] No.1).Or "Notice of Guangzhou Housing and Urban-Rural Development Bureau on Printing and Distributing Opinions on Further Standardizing the Relevant Matters Concerning the Selection of Cooperative Enterprises for Cooperative Renovation Projects in Old Villages" (Sui Jian Gui Zi [2020] No.16), where cooperative enterprises or cooperative enterprises are introduced and are still within the validity period of the agreement, cooperative transformation of old villages within their respective administrative areas shall be openly introduced according to the requirements of these work guidelines. (IV) Introducing Path Village Collective Economic Organizations Before introducing cooperative enterprises, they may introduce cooperative enterprises as needed. Introduce cooperative enterprises and cooperative enterprises in accordance with the procedures stipulated in these guidelines. Ii. conditions for introduction and contents of attracting investment (I) the qualifications and requirements of cooperative enterprises and cooperative enterprises are as follows: 1. the paid-in registered capital is not less than 500 million yuan (subject to the capital verification report). 2. Have the second-class qualification and above real estate development qualification, and have the development ability matching the transformed plots. Engaged in real estate development and operation for more than 3 years; There are not less than 20 professional managers with professional titles in construction, structure, finance, real estate and related economy, including not less than 10 managers with intermediate or above titles and not less than 3 full-time accountants with qualification certificates; The person in charge of engineering technology, finance, statistics and other businesses has the corresponding professional intermediate title or above. 3 in the past three years, the housing construction area has been completed more than 150,000 square meters;In Beijing, Shanghai, Guangzhou, Shenzhen and other first-tier cities in the country, at least one urban renewal and comprehensive transformation project has been completed or is being promoted. 4. Financial strength: the total assets of the enterprise shall not be less than 20 billion yuan for projects with the current construction area less than 600,000 square meters within the scope of transformation; The total assets of an enterprise with a current construction area of 600,000 square meters or more shall not be less than 30 billion yuan. The net assets of the enterprise shall not be less than 5 billion yuan. 5. It has the industrial layout and the ability to introduce industries that match the transformed plots, and conforms to the provisions of Article 8 of the Guidelines for the Introduction and Exit of Cooperative Enterprises in the Reconstruction of Villages in Guangzhou (Sui Jian Gui Zi [2021] No.1). 6. The enterprise has a good credit reputation, a strong sense of social responsibility, and a good bank credit record. It has been inquired by the national enterprise credit information publicity system, credit China (Guangdong, Guangzhou), the People’s Bank Credit Information Center and other departments in the past five years, and there are no serious violations of laws and regulations and records of not stressing integrity in the departments of financial supervision, market supervision, taxation, construction and planning of land, urban management, education, culture, tourism, health and health, and there is no "unfinished" or engineering. By inquiring the records of Guangzhou Public Resource Trading Center, there is no case of suspension or cancellation of bidding qualification according to law. 7. In the real estate and other projects developed by an enterprise in Haizhu District, if there are any supporting facilities that have not been handed over to the public and do not cooperate with land acquisition and demolition, it is deemed that there is a problem with the integrity and credibility of the enterprise, which does not meet the relevant provisions of point 6 above. 8. The enterprise is a company established in Haizhu District to undertake the renovation project of the old village, and its controlling shareholder.(The shareholding ratio must be ≧51%) If the enterprise meets the qualifications and conditions specified in points 2-7 above, and promises to take joint responsibility for the old village renovation project, it is deemed that the enterprise meets the corresponding qualifications and conditions. 9. In principle, the number of members of an enterprise consortium shall not exceed 3, and the main enterprise with the above qualifications shall occupy no less than 51% of the consortium. Other requirements for the membership of the remaining consortium may be set according to the actual needs of the project. 10. For enterprises with outstanding industrial layout or industrial introduction ability (non-real estate industry), but without corresponding real estate qualifications, development ability and experience, they can form a consortium with enterprises with the above-mentioned fifth real estate development ability and experience to participate in the bidding for the transformation of old villages. 11. The enterprise shall, within 30 natural days from the date of signing the cooperation intention agreement or cooperation agreement, pay the performance bond of the cooperation intention agreement or the campaign deposit of the cooperative enterprise according to the following standards: (1) For the project with a land area of less than 30 hectares, it shall pay a performance bond or deposit of not less than 200 million yuan (cash); (2) For projects with a land area of more than (equal to) 30 hectares, a performance bond or deposit of not less than 300 million yuan (cash) shall be paid. 12. The introduced cooperative enterprise shall stipulate in the signed cooperation agreement that within one month from the date of signing the cooperation agreement, a project company with independent legal personality shall be established in Haizhu District, and industrial and commercial registration, tax registration and other formalities shall be handled; Without the consent of the village collective economic organizations, the project company shall not change its shareholders or transfer its equity. Otherwise,The contractual joint venture shall be liable for breach of contract. Before voting, the village collective economic organizations should study through the village collective party committee and report to the District Housing and Construction Bureau for guidance, and then make a collective vote. If the situation is complicated, the district housing and construction bureau will report to the leading group for urban renewal in the district. Enterprises (or private non-enterprise units) introduced through cooperative enterprises shall set up (or move in from outside) project companies (or other operating entities and private non-enterprise units, excluding relocated enterprises in the area and real estate enterprises) in Haizhu District within the agreed time. 13. The introduced cooperative enterprise shall undertake the construction of public welfare projects in the surrounding areas of the project, and allocate schools, hospitals and supporting facilities in accordance with the requirements of Articles 12 and 13 of the Guidelines for the Introduction and Exit of Cooperative Enterprises in the Reconstruction of Villages in Guangzhou (Sui Jian Gui Zi [2021] No.1), so as to improve the overall efficiency of the old village reconstruction. 14 other conditions that need to be set according to the actual situation of the old village renovation project. 15. If the city newly introduces the necessary conditions in the relevant documents for the introduction of cooperative enterprises in the future, this part should be added. If there is any conflict between these guidelines and the new policies of the city in the future, they shall be implemented according to the standards not lower than those of the new policies of the city. (II) Contents of Investment Promotion The investment promotion document shall include the following contents: 1. Basic information of the transformation object and the basic data results of the old village audited and published by the district government. 2. Introduce the qualification requirements of the cooperative enterprise. 3. The idea and preliminary plan of project renewal and transformation compiled by the applicant cooperative enterprise according to the basic data published by the government.4. Requirements for the cooperative enterprise to introduce resources such as industry, education and medical care. A cooperative enterprise shall sign a supervision agreement and a letter of commitment according to the requirements of the District Investment Promotion Bureau, clarify the contents and requirements of industrial introduction, and clarify the construction and operation requirements of public facilities such as education and medical care, so as to ensure substantial progress in project construction within three years and substantial results in industrial introduction after project construction; The performance of the contract is included in the integrity management. 5. The methods and procedures for openly introducing the cooperative enterprise (including the composition of the qualification review team, etc.). 6. Substantive contents such as cooperation agreement and requirements for the amount of deposit. 7. Evaluation methods and standards. 8. Other contents that should be included. Third, the introduction of cooperative intention enterprise process (a) announcement and qualification review 1. The proposal of the village collective party Committee whether to introduce cooperative intention enterprises, after being studied and approved by the village collective "two committees", will be voted by the members’ congress. 2. Within 20 natural days after the vote is passed, the village collective economic organization shall prepare and complete the announcement on the open introduction of cooperative enterprises, and submit it to the local streets, which shall solicit the opinions of the District Housing and Construction Bureau. 3. The village collective economic organizations publish the announcement information of openly introducing cooperative enterprises within the village scope, and accept the registration. The announcement time is 5 working days, and the registration time is 3 natural days. 4. On the basis of soliciting villagers’ opinions and according to the model provided by the District Housing and Construction Bureau, the village collective economic organization drafts the cooperation intention agreement, which is submitted to the local street for review after being studied and agreed by the village collective party committee.The territorial street shall solicit the opinions of the District Housing and Construction Bureau in writing, and the District Housing and Construction Bureau shall give a written reply. 5. After receiving the registration materials of the participating enterprises, the village collective economic organizations, under the organization of local streets, conduct field visits to the headquarters of the participating enterprises and the comprehensive renovation project of the old villages, review the registration materials, and put forward a list of candidate cooperative enterprises. District Housing and Construction Bureau shall, jointly with the local street, organize the district public security bureau, the District Bureau of Industry and Commerce, the District Bureau of Agriculture and Rural Affairs, the District Market Supervision Bureau, the District Planning Resources Bureau and the District Taxation Bureau to conduct qualification examination on the list of candidate cooperative enterprises and registration materials put forward by the village collective economic organizations, and the local street will feed back the examination opinions to the village collective economic organizations within 10 working days. (II) Determination of cooperative intention enterprises 1. Within 20 natural days after the qualification examination of the candidate cooperative intention enterprises is passed, according to the Regulations on the Administration of Rural Collective Economic Organizations in Guangdong Province, the District Agriculture and Rural Bureau will guide the local neighborhood organizations to organize village collective economic organizations to hold a general meeting or a meeting of members’ representatives to vote on the enterprises that have signed up for the election and determine one cooperative intention enterprise. 2. Before voting, the village collective economic organization may hold a presentation on the candidate enterprises. The presentation order of the candidate enterprises shall be decided by lot, and the presentation time shall generally not exceed 20 minutes. Representatives of the candidate enterprises shall truthfully introduce the basic situation of the enterprises, competitive advantages and ideas for the renovation of the project, and shall not exaggerate words and attack other candidate enterprises, preach specific compensation standards, or conduct relevant publicity in violation of laws and regulations. Once found, they shall be disqualified from the presentation.3. When voting, the village collective economic organization shall hold a general meeting or a representative meeting of members to vote in accordance with the provisions of Article 10 of the Regulations on the Administration of Rural Collective Economic Organizations in Guangdong Province. Participants shall comply with the provisions of Article 10 of the Regulations on the Administration of Rural Collective Economic Organizations in Guangdong Province. If there is only one candidate enterprise, it can be determined as a cooperative enterprise if it is approved by more than half of the members present at the meeting or more than two-thirds of the members’ representatives; If there are more than one candidate enterprise, the enterprise with the highest number of votes and more than half of the members present or more than two-thirds of the members’ representatives will be selected as the cooperative intention enterprise; If the number of votes passed in the first round of voting does not reach more than half of the actual members or more than 2/3 of the members’ representatives, the top two enterprises with the highest number of votes in the first round of voting will be selected for the second round of voting on the spot, and those with more than half of the actual members or more than 2/3 of the members’ representatives will be identified as cooperative enterprises; If there is a tie for the highest number of votes in the first round, the enterprise with the highest tie will be voted in the second round on the spot. If the number of votes passed by the voting reaches more than half of the actual members or more than two-thirds of the members’ representatives, it will be determined as a cooperative enterprise. If the result of the second round of voting is that the number of votes passed by the candidate enterprises does not reach more than half of the actual members or more than 2/3 of the members’ representatives, and the enterprises with cooperative intentions cannot be selected, the work of introducing enterprises with cooperative intentions will be terminated. After 15 natural days, the village collective economic organizations can resume the introduction of cooperative enterprises.4. The village collective economic organization shall report the preliminary voting results to the local street and district housing construction bureau for review after the consent of the village collective party committee. After examination, the village collective economic organization will publicize the list of cooperative enterprises within the village area for more than 7 natural days, and record (photograph) the publicity process and results. 5. There is no objection at the expiration of the publicity period, and after being audited by the local street and district housing and construction bureau, the village collective economic organization will sign a cooperation intention agreement with the cooperative intention enterprise within 5 natural days; Within 10 natural days from the date of signing the cooperation intention agreement, the list of cooperative intention enterprises and the cooperation intention agreement shall be copied to the district government according to the procedures, and the list of cooperative intention enterprises shall be published within the village area. (3) The validity period of the cooperation intention agreement for task assessment shall not exceed 2 years in principle. Within three months after the signing of the cooperation intention agreement, the District Housing and Construction Bureau, local streets, village collective economic organizations and cooperative intention enterprises shall sign a supervision agreement for the renovation project. Enterprises that have signed cooperation intention agreements with village communities should cooperate with the government to sign supplementary supervision agreements. In addition to the necessary clauses, the supervision agreement should also stipulate that within the validity period of the cooperation intention agreement, the cooperative intention enterprises should complete the following tasks within the specified time: for the old villages that have started the basic data survey, they should cooperate with the village collective economic organizations to complete the work of inviting public investment and introducing cooperative enterprises within 18 months. For the old villages that have not started the basic data survey, we will cooperate with the village collective economic organizations to complete the work of inviting public investment and introducing cooperative enterprises within 24 months. If the related tasks are not completed according to the above node time,The District Housing and Construction Bureau or the local street will issue a supervision letter, and interview the main person in charge of the village collective economic organization and the person in charge of the cooperative enterprise. If the task has not been completed for two consecutive times, it will be handled according to the compulsory withdrawal mechanism. (IV) Management of performance bond If it is stipulated in the cooperation intention agreement that the enterprise pays the performance bond, the following contents can be agreed in the agreement at the same time: 1. The performance bond paid by the cooperative intention enterprise shall be deposited in the account jointly supervised by the village collective economic organization and the enterprise, and no one may withdraw or misappropriate it without the unanimous consent of the village collective economic organization and the enterprise; 2. If the village collective economic organization and the cooperative intention enterprise reach an agreement through consultation and are voted by the members’ congress, or meet the termination conditions stipulated in the cooperative intention agreement, the principal and interest of the performance bond shall be returned to the cooperative intention enterprise; 3. When the cooperative intention enterprise signs up for the follow-up cooperative enterprise’s open investment invitation, the performance bond paid can be converted into campaign deposit; If the performance bond is lower than the deposit amount required by the investment invitation documents, the difference shall be filled. Iv. process of introducing cooperative enterprises (I) preparation and preliminary examination, examination and approval of investment documents The village collective formulates investment documents for the open introduction of cooperative enterprises under the guidance of local streets. Upon the motion of the village collective party Committee, the first draft of the investment invitation document for the old village renewal and reconstruction project prepared by the village collective economic organization shall be submitted to the local street after the consent of the village collective party Committee, and the local street shall solicit the opinions of the functional departments in the member units of the district urban renewal leading group after the preliminary examination of the investment invitation document. If the local street is inconsistent with the administrative street of the village collective economic organization,It is also necessary to seek the opinions of the administrative street. According to their functions, all units put forward opinions on the first draft of investment promotion documents from the aspects of planning, industry and policy. The local street guides the village collective economic organizations to revise and improve the investment documents according to the feedback. The village collective economic organization will submit the revised draft of the investment invitation document (with feedback) to the District Housing and Construction Bureau according to the procedure, which will be reviewed and confirmed by the District Housing and Construction Bureau and submitted to the district urban renewal leading group meeting for approval. (II) Voting on Investment Promotion Documents If the meeting of the leading group for urban renewal in the district proposes amendments to the investment promotion documents, the village collective economic organizations will vote on the revised investment promotion documents; if there are no amendments, they will vote on the investment promotion documents that have been reviewed. Before voting, it should be announced in the village affairs column in advance, and the announcement time should be no less than 5 working days. After the members’ congress of the village collective economic organization votes, the village collective economic organization shall publicize the voting results and investment promotion documents in the village affairs public column within 3 natural days from the date of voting, and the publicity time shall not be less than 5 working days, and accept the supervision of the members of the village collective economic organization. At the same time, the District Housing and Construction Bureau shall send a copy to the Municipal Housing and Urban-Rural Development Bureau. (III) Announcement 1. The village collective economic organization entrusts the investment promotion agency to publish the announcement information in the Guangzhou Public Resource Trading Center, and the date of issuing the tender announcement for the introduction of cooperative enterprises shall not be less than 30 natural days from the bidding deadline. 2. The applicant cooperative enterprise shall submit the qualification examination materials and pay the campaign deposit according to the requirements of the investment announcement. (4) Qualification examination 1. After the deadline for registration,A qualification review team is organized by the investment promotion agency. The qualification examination team is composed of expert members, district functional departments, street representatives of the project territory and representatives of members of the village collective economic organizations, and conducts qualification examination and confirmation on the registered cooperative enterprises. The qualification review team consists of 7 members, including 2 experts, 1 representative of the District Housing and Construction Bureau, 1 representative of the District Planning and Resources Branch, 1 representative of the local street, and 2 representatives of the members of the village collective economic organization (which may be composed of representatives of the village collective party committee, social committee members or other members, and shall be determined by the leadership meeting of the village collective economic organization before the qualification review is confirmed). Expert members are drawn from the expert database of Guangzhou urban renewal by the investment promotion agency. The representative of the District Housing and Construction Bureau (a cadre at or above the official level) serves as the leader of the qualification review team. The qualification review team shall review the introduction conditions of cooperative enterprises and cooperative enterprises. Before the qualification examination, the application materials should be fully consulted by the departments of market supervision, taxation, land planning, urban management, education, health, culture, tourism and sports. 2. After passing the qualification examination, the qualification examination team will issue the qualification examination results, and the Guangzhou Public Resource Trading Center will confirm the candidate qualification of the cooperative enterprise and notify it to participate in the voting activities. The village collective economic organization shall announce the list of candidate cooperative enterprises through the village affairs column, and the announcement time shall not be less than 5 working days. 3. As long as there is no less than one enterprise that has passed the qualification examination, this open introduction of cooperative enterprises is effective. (5)Determination of cooperative enterprises 1. Village collective economic organizations shall hold a general meeting of members or a meeting of representatives of members in accordance with the provisions of Article 10 of the Regulations on the Administration of Rural Collective Economic Organizations in Guangdong Province, and vote on the candidate cooperative enterprises to determine the winning cooperative enterprises. 2. Before voting, the village collective economic organization may hold a presentation meeting of the candidate enterprises, and refer to the relevant provisions of point 2 of paragraph (2) of Article 3 of these Guidelines. 3. Voting procedures shall be implemented with reference to the relevant provisions in point 3 of paragraph (2) of Article 3 of these Guidelines. 4. If two rounds of voting fail to select a cooperative enterprise, the activity of introducing a cooperative enterprise will be terminated. It will take 15 natural days for village collective economic organizations to re-introduce cooperative enterprises according to these guidelines. (VI) Publicity of voting results Within three natural days after the voting results are studied by the village collective and reported to the village collective party committee for approval, the village collective economic organization shall publicize the voting results in the village affairs column, the project location and the Guangzhou Public Resource Trading Center for not less than five working days. And the publicity process and publicity results are recorded (photographed) on file. (VII) Signing a cooperation agreement 1. Upon the expiration of the publicity period, the winning cooperative enterprise shall pay the public resource transaction service fee according to the time and amount specified by the Guangzhou Public Resource Trading Center after receiving the notice from the Guangzhou Public Resource Trading Center. The village collective economic organization shall, within 5 natural days from the date of receiving the Confirmation of Transaction issued by Guangzhou Public Resources Trading Center, issue the Notice of Cooperative Transformation to the competing cooperative enterprises.And send a copy to the district housing and construction bureau and the local streets. 2. The village collective economic organization shall sign a cooperation agreement with the competing cooperative enterprise within the time specified in the investment invitation documents from the date of issuance of the Notice on Cooperative Transformation. The cooperation agreement shall specify the specific rights and responsibilities of the cooperative enterprise, and submit the cooperation agreement to the local street and district housing and construction bureau. Within 30 natural days from the date of signing the cooperation agreement, the local street will report the investment results to the district government and be responsible for publishing them on the portal website of the district government, and the District Housing and Construction Bureau will report the investment documents and investment results to the Municipal Housing and Urban-Rural Development Bureau. (VIII) Management of campaign deposit 1. A campaign deposit supervision account shall be set up as required, and the deposit shall be collected and deposited with the campaign deposit supervision account. Enterprises applying to participate in the election of cooperative enterprises shall pay the election deposit according to the prescribed amount before passing the qualification examination. 2. The village collective economic organization shall, within 30 working days from the date of the expiration of the publicity of the investment promotion results, return the campaign deposit of the uncompetitive cooperative enterprise and the interest on its bank deposits in the same period. After the signing of the cooperation agreement, the campaign bond of the winning cooperative enterprise will be converted into the performance bond of the cooperation agreement. (9) Within three months after the signing of the task assessment cooperation agreement, the District Housing and Construction Bureau, local streets, village collective economic organizations and cooperative enterprises shall sign a supervision agreement on the renovation project, clarify the construction and operation requirements of public facilities such as education and medical care in the renovation of villages in the city, and clearly introduce the specific requirements such as the type, quantity and economic benefits of industrial enterprises, the time of reaching production and the standard of reaching production, and stipulate the payment of bank performance bonds.And appoint corresponding departments to strengthen supervision during and after the event to ensure the contractual joint venture’s performance. The supervision agreement should also stipulate that within the validity period of the cooperation agreement, the cooperative enterprise should assist the village collective economic organizations to accelerate the renovation and reconstruction projects of old villages. In principle, it is required to complete the following tasks within the specified time: from the date of signing the cooperation agreement, the district planning scheme and the detailed planning modification scheme should be approved within 9 months; Complete the examination and approval of the implementation plan, vote on the compensation and resettlement plan and start the signing of the compensation and resettlement agreement within 18 months; Complete the signing of the compensation and resettlement agreement for the houses on the first phase of reconstruction and resettlement plots within 24 months; Start the first phase of reconstruction and resettlement housing construction within 30 months; Within 36 months, complete the relocation and delivery of houses on all rebuilt resettlement plots; Within 40 months, all the resettlement houses will be rebuilt and started construction; The reconstruction of resettlement houses will be basically completed within 60 months. In addition to the above-mentioned time nodes, we should reverse the construction period and refine the task nodes in accordance with the requirements of Guangzhou Work Plan for Deepening Urban Renewal and Promoting High-quality Development, combined with the actual situation of specific projects, to ensure the completion of the following assessment objectives: the old villages listed in the city’s "three-year implementation plan" and the old villages whose transformation implementation plans have been approved will basically complete the reconstruction and resettlement housing construction by the end of 2023; The old villages listed in the "three-year implementation plan" and whose transformation implementation plan has not been approved will start construction before the end of 2023, and the reconstruction of resettlement houses will be basically completed before the end of 2025; The old villages listed in the "Five-year Action Plan" of the city will be rebuilt and resettlement houses will start construction before the end of 2025.The reconstruction of resettlement houses will be basically completed by the end of 2030. If the relevant tasks are not completed according to the node time, the District Housing and Construction Bureau and the local streets will issue a supervision letter and interview the main person in charge of the village collective economic organization and the person in charge of the cooperative enterprise. If the tasks have not been completed after two consecutive supervision, they will be dealt with according to the mandatory withdrawal mechanism. V. Division of functions (I) Village collective economic organizations Village collective economic organizations are the main implementers of old village renovation projects, and they are also the main implementers of cooperative enterprises or cooperative enterprises that are openly introduced into old village renovation projects. In the open introduction of cooperative enterprises and enterprises with cooperative intentions, the announcement of decision-making motions and voting results should be reported to the village collective party committee for approval, and general party membership meeting should be organized to discuss and report relevant information. The village collective party committee should perform the duties of leadership, organization, overall planning and supervision, and organize the work of declaration and voting, including entrusting Guangzhou Public Resource Trading Center to issue investment announcement and conduct qualification examination on the participating enterprises, voting on the candidate enterprises, and finally signing an agreement with the determined cooperative enterprises or enterprises with cooperative intentions. (II) Territorial Streets Territorial streets are responsible for reviewing the information of cooperative intention enterprises submitted by village collective economic organizations and the drafted cooperative intention agreements, conducting preliminary examination of investment invitation documents prepared by village collective economic organizations, and supervising the whole process of openly introducing cooperative enterprises and cooperative intention enterprises, daily supervision and maintaining stability. (3) District Housing and Construction Bureau The District Housing and Construction Bureau cooperates with the street to review the information of the cooperative intention enterprise and the cooperative intention agreement.Review and confirm the investment invitation documents for introducing cooperative enterprises, and assist local streets to supervise and guide the whole process of openly introducing cooperative enterprises. Formulate format texts of series of documents such as investment invitation documents and cooperation framework agreements for rural collectives to refer to. (IV) Investment Promotion Agency The investment promotion agency is responsible for compiling investment promotion documents and organizing investment promotion according to its own requirements, and assisting the village collective economic organizations in determining candidate cooperative enterprises. (V) Guangzhou Public Resource Trading Center Guangzhou Public Resource Trading Center is responsible for issuing investment announcements, providing venues for qualification examination activities and publicizing the voting results. (six) the District Investment Promotion Bureau shall, after the establishment of the cooperative enterprise, clarify the contents and requirements of industrial introduction with the cooperative enterprise, so as to ensure substantial progress in the project construction within three years and substantial results in industrial introduction after the project construction. (VII) Other departments Other departments shall cooperate with each other to do guidance and related work within their respective functions. VI. Safeguard Measures (1) Establishing a supervision and supervision mechanism The Housing and Construction Bureau of the district and the local streets should strengthen the supervision and management of the open introduction of cooperative enterprises and cooperative enterprises in the old village cooperative transformation projects, focusing on strengthening the supervision and management of investment promotion activities; All the votes involved in this work guide shall be witnessed by the District Housing and Construction Bureau, the District Agriculture and Rural Bureau and the local street site; Where the village collective economic organizations or community monitoring stations should strengthen supervision, supervision committee should strengthen the supervision of village affairs, and can supervise all aspects of the whole process of old village reconstruction. (2)The investment documents, cooperation agreements and supervision agreements for establishing the mechanism of breach of contract and dishonesty withdrawal shall specify the liability for breach of contract and withdrawal of the cooperative enterprise (or cooperative intention enterprise). If the imported cooperative enterprises and cooperative intention enterprises fail to perform their duties conscientiously, fail to complete the project assessment task according to the node time specified in these guidelines, or have other behaviors that lead to the slow construction period of the old village reconstruction project and affect the implementation of the project, or under the circumstances specified in Articles 18 and 19 of the Guidelines for the Introduction and Exit of Cooperative Enterprises in the Reconstruction of Villages in Guangzhou (Sui Jian Gui Zi [2021] No.1), the village collective economic organizations will order the enterprises to withdraw after voting in accordance with democratic decision-making procedures. The Housing and Construction Bureau of the designated district of the district government strengthens the supervision of the implementation of the supervision agreement and urges the cooperative enterprises (cooperative enterprises) to perform their duties according to law. If the cooperative enterprise (cooperative intention enterprise) violates the supervision agreement and meets the withdrawal clause, the District Housing and Construction Bureau may also start the withdrawal procedure of the cooperative enterprise (cooperative intention enterprise) according to the supervision agreement. Enterprises that have been ordered to quit are not allowed to participate in the urban renewal and transformation work in Haizhu District. After the withdrawal of cooperative enterprises or cooperative intention enterprises, the district government will guide the village collective to start the selection of new cooperative enterprises or cooperative intention enterprises in the villages whose transformation work has not been completed. The early investment of the withdrawn cooperative enterprise or cooperative intention enterprise shall be compensated reasonably according to the agreement. (3) If the establishment of an opinion feedback mechanism has any objection to the process of introducing the cooperative enterprise, it may, within the period of publicity of the results,Query the village collective economic organization in writing. The village collective economic organization shall, within 5 working days from the date of receiving the written question, reply to the question. If you are dissatisfied with the reply or fail to receive the reply within the specified time, you can complain to the District Housing and Construction Bureau or the local street within 5 working days from the date of expiration of the reply. The District Housing and Construction Bureau or the territorial street shall decide whether to accept the complaint within 3 working days from the date of receiving it. If it is accepted, it shall take the lead in coordinating the relevant units to jointly study and make a reply to the complaint within 30 working days from the date of acceptance. If a question or complaint is raised within the time limit, it will not be accepted. VII. Supplementary Provisions The Housing and Construction Bureau of Haizhu District, Guangzhou shall be responsible for the interpretation of these work guidelines; It will be implemented as of the date of issuance and will be valid for 5 years. The basis of relevant laws and policies changes or expires, and shall be revised according to the implementation.
