  According to the survey of the UK Anti-Financial Fraud Action Group, in 2015, there were mainly the following types of financial fraud in the UK. The first is to pretend to be a bank, a police officer, or a government public department, make a phone call or send a text message or email, and get the user’s bank card or credit card information. Its excuses usually include paying an emergency expenditure, refunding a certain fee, and upgrading an account. Different from the domestic bank card "password verification can be set for online or offline consumption", credit cards in the UK are generally used for direct credit card consumption or signature consumption. If you use a credit card or debit card through the Internet or telephone, there is still no password setting. Generally, you only need to provide the card number and the 3-digit number printed on the back of the card. Therefore, if the personal card number and the three digits on the back are leaked, it will be easily stolen by others.

  When the reporter first came to Britain, he was repeatedly reminded by his friends that he must not easily tell others the bank card number and the three digits on the back. On weekdays, reporters also received many calls for payment, some from formal large enterprises, such as power companies; Others can’t confirm the authenticity of their identity. In this case, it is safer to refuse to pay by phone and log in to the official website to pay.

  The second common type of fraud is stealing and copying bank card information. The timing of the attack is often when the cardholder operates at an ATM or POS machine, or swipes the card to shop.

  The third common type of fraud is the increasing network attacks and thefts, which are often committed through links with Trojans and fake websites.

  In the face of endless financial fraud tricks, British banks and relevant regulatory authorities are committed to studying and adopting newer and better preventive measures. According to reports, the security system adopted by the Bank of England in 2015 prevented about 70% of fraud. Some of these measures include: developing new security tools, especially biometrics, consumer behavior identification technology, etc. If the recent trading behavior of an account is quite different from usual, it will contact the customer in time for confirmation; Strengthen cooperation with government departments, financial regulatory agencies and other relevant units to jointly crack down on financial fraud and ensure timely communication of information and data; Use various methods to remind users to pay attention to cultivating account security awareness and prevent financial fraud.

  In addition, the official websites of major banks in the UK have information to remind cardholders to use bank cards and credit cards safely, including: personal information related to accounts should not be disclosed to anyone; Be sure to pay attention to whether the website is safe when shopping online; Check the bank statement regularly, be aware of your own consumption, and notify the bank in time if you find any suspicious signs; Receipts, bills and invoices after swiping the card at ordinary times should be properly kept.

  At present, all major banks in the UK have opened 24-hour customer service telephones. After discovering that the credit card has been stolen, as long as you call the bank, the account will be closed and the staff will check it and send a new card.

  United States:

  Spot check customer identity

  Stealing brushes costs a lot.

  Major banks in the United States have different preventive measures to prevent credit cards from being stolen in large quantities and continuously. Take the Bank of America credit card used by the reporter as an example. If the banking system detects abnormal consumption of the credit card, it will send a short message and temporarily freeze the credit card. Every time a reporter goes on a business trip in a foreign country and spends twice with a credit card, it will be temporarily frozen. The bank sends the latest consumption record through SMS, and the bank will lift the freeze after the cardholder confirms it.

  There are also strict regulations on the use of credit cards in the United States, and it is not allowed to use other people’s credit cards to spend money, even for a family. Merchants will check the identity documents of consumers from time to time, and once they find that the identity of the cardholder is inconsistent with that shown on the credit card, they will refuse to accept the card.

  If the cardholder reports the stolen credit card to the bank, the bank will freeze the card in time and send a new card to the cardholder, and the cardholder does not have to bear the loss. At the same time, the bank will ask the cardholder to call the police and find out the truth by checking the signature. Most banks buy credit card insurance, and the compensation for cardholders is ultimately borne by the insurance company, so there is no reason for banks not to protect the rights and interests of cardholders.

  If the cardholder has any objection to the consumption, calls the bank and the bank trusts the customer, then the disputed amount will be returned to the cardholder first, and then communicated with the merchant. Of course, if it is finally determined that it is the fault of the cardholder, the cardholder will have to pay the full amount of consumption and even pay interest.

  In the United States, stealing other people’s credit cards is a serious crime, and the punishment measures stipulated by each state are different, but they are generally more severe. In Virginia, where the reporter is located, the law stipulates that stealing someone else’s credit card can be fined up to $10,000 and imprisoned for 20 years. In the face of severe punishment measures, the cost of stealing other people’s credit cards is very high, and most people dare not easily break the law.

  If the cardholder conceals his own consumption and maliciously deceives the bank, the cardholder will not only compensate and bear legal responsibility, but also record his behavior in the credit system. Once you have a bad credit record, all aspects such as applying for a credit card and buying insurance will be affected, which can be said to be difficult.

  Germany:

  The insurance mechanism is sound

  German credit cards have always adhered to the principle of "convenience for cardholders". Except for a small number of bus ticketing machines, you need to enter the PIN code, and most of the counter consumption can be done by signing. In some parking lot payment machines, the card is directly deducted without any verification after being inserted.

  Although the use of credit cards in Germany does not require a password, and cashiers rarely check their signatures carefully, thieves are not "cold" about it. There are many cases where the wallet is stolen and the cash is lost, but the credit card is intact. The reporter has experienced it personally. German police once explained to reporters that no matter whether they are operating in machines or shopping malls, most of them are equipped with cameras nearby, which will definitely leave traces of the time and place of consumption, so thieves will not "take this big risk".

  High convenience is always accompanied by high risks. Although thieves dare not steal credit cards in public places, cyber hackers can hide behind the screen and commit crimes. Since most credit cards in Germany don’t popularize SMS consumption reminder service, theoretically, as long as you know the cardholder’s name, card number, 3-digit security code on the back of the card and the expiration date, you can make any consumption online. This is not difficult for network hackers.

  During the one and a half years in Germany, the reporter was forced to change three credit cards because of this kind of network theft. In the worst case, thousands of euros were stolen, and a large amount of money was spent in Shanghai, Dubai, Paris and other places within one day. Finally, the reporter learned that the card was stolen because the bank became suspicious and stopped the card and informed the reporter.

  However, cardholders who have been stolen should not be too flustered. When the cardholder contacts the customer service of the credit card or goes directly to the bank counter to complain, the bank will ask the cardholder to explain the actual use of the credit card in person or in writing, and sometimes make a preliminary verification. After it is confirmed that the hacker forged the consumption record, the bank will ask the cardholder to fill in the compensation complaint form and send it back to the complaint acceptance center, which can generally eliminate the stolen payment on the next settlement date. As far as the reporter’s experience is concerned, it generally takes no more than three weeks from the bank accepting the complaint to eliminating the stolen debts, and there will be no stalemate or dispute between the bank and the cardholder. As long as it can be proved that the stolen brush is not caused by personal negligence such as losing the card, the cardholder will appeal successfully.

  The reason why cardholders and banks can be so calm is related to the perfect credit card insurance mechanism. According to the staff of the German Savings Bank, banks will make huge investments in credit card insurance every year. With "all risks", the bank can claim compensation from the insurance company, that is, the stolen money will eventually be paid by the insurance company. The insurance company will further let its investigation team investigate and contact the police. In addition, Germany has a "lawyer’s insurance" that can pay the lawyer’s fees for prosecution and police investigation. The monthly cost is about tens of euros, and most people will buy it. Cardholders will generally cooperate with banks, report to the police and go through legal procedures to bring the real murderer to justice.

  Despite this, the German police told reporters that most of the hackers are international criminals who operate remotely across borders and are often difficult to track down. The financial situation is relatively stable and the credit structure has been effectively adjusted. The annual cash income of banks reached 65.232 billion yuan, up 6.2% over the previous year; Bank cash expenditure was 65.635 billion yuan, an increase of 6.3%.   Nowadays, QR code payment is widely used in offline micropayment scenarios such as restaurants, supermarkets and convenience stores. In order to strictly implement the requirements of high-quality development, further standardize the patent application behavior, improve the quality of patent application, and eliminate the abnormal patent application behavior not aimed at protecting innovation, the relevant matters are hereby notified as follows:

First, clear work objectives

Efforts will be made to guide the number and quality of patent applications to adapt to the level of regional economic development, industrial development needs and scientific and technological innovation capabilities, scientifically set various work indicators, strengthen quality guidance, and effectively play the leading role of high-quality development indicators. Further adjust and improve policies such as funding and incentives, completely cancel funding for patent applications, and focus on increasing support for subsequent transformation and application, administrative protection and public services. Clean up and standardize the order of patent applications, resolutely crack down on and effectively curb abnormal patent applications that do not aim at protecting innovation, and promote the high-quality development of intellectual property rights.

Second, grasp the key points of work

The implementation of the following abnormal patent applications (hereinafter referred to as such applications) for the purpose of protecting innovation shall be severely cracked down and dealt with in accordance with relevant laws, regulations and policies.

(1) Six situations stipulated in Article 3 of Several Provisions on Regulating the Behavior of Patent Application (Decree No.75 of China National Intellectual Property Administration);

(2) Units or individuals intentionally submit related patent applications in a decentralized manner;

(3) The entity or individual submits a patent application that is obviously inconsistent with its R&D capability;

(four) the unit or individual abnormal reselling patent applications;

(5) The patent application submitted by a unit or individual has obvious behaviors that do not conform to the common sense of technical improvement, such as technical scheme to realize simple functions with complex structure, combination or stacking with conventional or simple features;

(six) other acts that violate the principle of good faith stipulated in the Civil Code, do not conform to the relevant provisions of the Patent Law, and disturb the order of patent application management.

The above "units and individuals" include the same natural person, legal person, other organizations and the same actual controller.

Third, strengthen work measures

For this kind of application, in addition to strictly handling the submitted patent application according to the provisions of the Patent Law and its detailed rules for implementation, the following measures should be taken according to the circumstances:

(1) The patent fee shall not be reduced for the applicant. If it has been reduced, it is required to pay back the reduced fees. If the circumstances are serious, the patent fee shall not be reduced within five years from this year.

(two) in the China National Intellectual Property Administration municipal government website and "China Intellectual Property News" to be informed.

(3) Deduct the number of such applications from the statistics of the number of patent applications.

(four) cancel the declaration of national intellectual property demonstration and advantage enterprises, intellectual property protection center for the record enterprise qualifications, and China patent award declaration, participating or winning qualifications.

(five) the local intellectual property departments at all levels shall not subsidize or reward the applicant and the relevant agencies. Those that have been funded or rewarded shall be repaid in whole or in part. If the circumstances are serious, it will not be funded or rewarded within five years from this year. Those involved in defrauding financial aid awards are suspected of constituting a crime, and shall be transferred to relevant authorities for criminal responsibility according to law.

(6) Local intellectual property departments at all levels shall intensify investigation and handling of patent agencies that represent such applications and seriously disrupt the order of patent work according to the identification. The All-China Association of Patent Agents takes industry self-discipline measures against patent agencies and patent agents engaged in and involved in such applications.

Fourth, strengthen collaborative governance

(A) improve the scientific assessment indicators. Local intellectual property departments at all levels should firmly establish the concept of high-quality development, actively coordinate with relevant departments to further improve and perfect the evaluation index system related to patent work, improve the scientificity and effectiveness of the evaluation, check and eliminate the growth rate evaluation indicators that are not in line with reality, and avoid taking the number of patent applications as the main basis for the evaluation of departmental work. It is not allowed to set binding assessment and evaluation indicators for the patent application amount, and it is not allowed to apportion the patent application amount indicators to localities, enterprises and agencies by administrative orders or administrative guidance. It is not allowed to compare the number of patent applications (including patent applications through the Patent Cooperation Treaty (PCT)). Once the above behaviors are discovered, the qualification for applying for national intellectual property operation projects, the title of demonstration city awarded by China National Intellectual Property Administration and other preferential policies will be cancelled as appropriate.

(2) Adjusting the patent subsidy policy. Before the end of June 2021, all levels of patent application funding should be completely cancelled. All localities shall not give financial support to patent application in any form, such as funding, incentives and subsidies. The scope of existing local funding should be limited to authorized invention patents (including invention patents authorized overseas through PCT and other means), and the funding method should be in the form of post-authorization subsidies. The total amount of all kinds of subsidies received by the aided object shall not be higher than 50% of the official fees paid for obtaining the patent right, and shall not subsidize the annual patent fee and intermediary service fees such as patent agency. For those who resort to deceit to obtain patent grants, the allocated funds shall be recovered within a time limit. During the "Fourteenth Five-Year Plan" period, all localities should gradually reduce all kinds of financial support for patent authorization and cancel it all before 2025. All localities should focus on optimizing the use and management of financial funds related to patent funding, strengthening the use of patent protection, and focusing on increasing support for subsequent transformation and use, administrative protection and public services.

(3) Highlight the quality orientation of patent applications. China National Intellectual Property Administration regularly reports or publishes local high-quality patent applications and data on the proportion of such applications. If the proportion of such applications increases for two consecutive quarters and the proportion of high-quality patent applications decreases for two consecutive quarters, the local intellectual property department shall be notified. If the above phenomenon occurs for three consecutive quarters, it shall be notified to the local Party committee and government, and the relevant information shall be published on the website of China National Intellectual Property Administration Municipal Government and China Intellectual Property News. If the above phenomenon occurs for one year in a row, all kinds of titles and preferential policies such as demonstration cities awarded by China National Intellectual Property Administration will be cancelled. All kinds of awards involving patents shall not simply take the number of patent applications and authorizations as the main conditions.

(4) Strengthening credit supervision in the field of patent application. Revise the detailed rules for the implementation of the Patent Law, and promote the inclusion of this kind of application as an act of dishonesty in intellectual property credit supervision according to law. Intellectual property departments at all levels should focus on bringing such applications into the scope of supervision when formulating policy documents on intellectual property credit supervision. Strengthen the collaborative governance of serious illegal and untrustworthy agencies. For patent agencies that have been punished for representing such applications, they will be linked and restrained in terms of relevant incentive and reward policies and industry evaluation awards, so as to strengthen the supervision effect.

(five) to strengthen the standardization and supervision of patent transactions. Local intellectual property departments at all levels should implement the responsibility of territorial supervision to regulate intellectual property transactions, resolutely curb patent application rights and patent transfer activities that are obviously not aimed at technological innovation and implementation, strengthen supervision and guidance on intellectual property (patent) trading operation platforms and institutions supported by government departments at all levels, strengthen guidance on various patent trading service institutions and platforms in their jurisdictions, do a good job in reviewing the background of trading targets and traders, and prevent such applications from making profits and washing white through transactions. China National Intellectual Property Administration will strengthen the monitoring of patent transfer, licensing and other registration data, and deal with abnormal patent operation in a timely manner in conjunction with relevant places.

(6) Strengthen inter-departmental information reporting. For detailed information about such applications, local intellectual property departments at all levels should consult relevant departments, take the initiative to inform the administrative departments of science and technology in a timely manner, support and assist the administrative departments of science and technology to strengthen the administrative management of patent applications, and ensure that such applications are not used to defraud high-tech enterprises and other national preferential policies. For the "three noes" shell companies that have no insured, paid-in capital and R&D funds to apply for patents, it is necessary to timely transfer the relevant information to the local market supervision department for strict supervision.

V. Improve the working mechanism

(1) Work docking mechanism. China National Intellectual Property Administration continuously monitors and identifies this kind of application behavior, and timely informs and forwards relevant information about this kind of application behavior to the local authorities. The local intellectual property department strengthens administrative guidance and requires the units and individuals involved and the agency to voluntarily withdraw the relevant application. If the units and individuals involved and the agencies refuse to withdraw their complaints and provide sufficient evidence, the local intellectual property department will handle them according to the circumstances, and transfer the relevant clues to the market supervision department, the public security department and the credit supervision department according to law.

(2) Information screening mechanism. Patent examination departments and units should strictly examine and reject such applications according to law, and timely discover, summarize and submit relevant clue information. Patent agencies, intellectual property protection centers and intellectual property rights protection centers strictly screen such applications, and submit relevant clues to China National Intellectual Property Administration in time.

(3) Reporting and verification mechanism. Units and individuals are encouraged to report this kind of application behavior, illegal index setting and application funding policy to local intellectual property departments at all levels. Local intellectual property departments at all levels should set up special lines and networks to receive reports. After receiving the report, it should be checked and handled in time and reported to China National Intellectual Property Administration.

(4) Positive guidance mechanism. Actively carry out various forms of publicity and reports to improve the quality of patent applications, strengthen incentives for enterprises and individuals who actively invest in innovation and scientific and rational layout of patents, further enhance the strategic layout awareness and quality awareness of patent applications in the whole society, and effectively improve the quality of patent applications.

Sixth, promote the implementation of the work

Diao Yinan compared writing to going to an appointment, just as he had already thought of the name of the play before he started writing it: "The Wild Goose Lake".


As a screenwriter-turned-director, Diao Yinan feels that when he creates, the picture and the story are two-way thinking at the same time. His scripts clearly write some scenes and atmospheres, but at the same time add literary expression.


In his opinion, the process of writing a screenplay is a game of thinking, a succession of ordinary stories, coupled with the spiritual appeal of the film.

 

"How these things hide underneath your story to form an undercurrent, these are some very complex mind games. But in the end you have to transform it into emotion," Diao Yinan said.


This mind game has been going on for two years. He showed the written script to Li Li. Li Li felt that the cost and difficulty of filming "The Wild Goose Lake" would exceed "Fireworks in the Day".

 

This hugely successful film actually gave Diao Yinan confidence. It allowed him to find that with such a film in his hands, he could find better partners for future projects.



"The most important thing is that’Fireworks by Day ‘let me know that there is nothing wrong with you shooting genre films like this. Before, basically everyone regarded genre films as commercial films. There are strict routines for fighting and killing. Now I know very well that you can use it as an art to direct."

 

However, the process of "Fireworks in the Day" is still the production process of an independent art film. On the way out of the dilemma, Diao Yinan actually entered a new dilemma.

 

"The Wild Goose Lake" presents Diao Yinan with a great challenge compared to "Fireworks in the Day". 85% of the plot is night scenes. This means that the working hours are only 7 to 8 hours per day. The distance from the residence to the location is also almost 1 hour per day, and the shooting time is compressed even more.


"The Wild Goose Lake" is a full-scale integration with industrial production, said Shen Yan, another producer: "During this process, it is conceivable that the director himself faced a lot of pressure, and to some extent it was a painful transformation of himself. For creators like Diao Yinan, the insistence on quality is always the first priority, so all production plans and arrangements must also be based on this unshakable point."

 

2,500 group performances, more than 80 non-repeating scenes, and a 5-month shooting cycle. These demands also make the film’s cost pressure not to be underestimated. It is also for this reason that the film needs to use stars to ensure the radiation of the audience and the influence of the film in the future. After Shen Yan proposed to choose Hu Ge, Diao Yinan and Hu Ge met and hit it off.



Like Diao Yinan’s attempt to emerge from the huge reputation of "Fireworks by Day", Hu Ge also hopes to have a transformation in his acting career. The two "fugitives" go to the party together and actively enter a certain dilemma together.

 

Diao Yinan thought Hu Ge’s face was reminiscent of the beasts of the night: "They all seem to be in the jungle on the edge of a city, lurking or raiding at night, or evading hunters." He gave the face a lot of close-ups, but often did not tell Hu Ge the scene he used to shoot him.


This was Diao Yinan’s habit of "torturing" actors. Because when he told them, there would be hints in his heart, and the performance would be tightened rather than relaxed. He also used some difficult words to tell actors about the play.


Gui Lunmei recalled that when Diao Yinan asked her to have another one, she gave the instruction to "be more black."

 

But Diao Yinan felt that the actor could understand himself. This was his reaction according to his speaking habits. If the actor didn’t understand, he believed that he would let himself explain. If he didn’t need an explanation, then he understood. His reaction to the actor was still based on what the actor gave.

 

Hu Ge’s feelings about this were obvious. He recalled Diao Yinan’s demands on him, and was surprised that a director would make demands on his breathing ups and downs and blink frequency. In a close-up, Diao Yinan made it clear that Hu Ge should not blink twice.


Diao Yinan’s request brought a lot of anxiety to Hu Ge from the small screen to the big screen, forming an invisible dilemma. But Diao Yinan himself resonated deeply with this dilemma. When talking about the success of getting out of "Fireworks in the Day", he compared himself to Hu Ge’s role:

 

"Hu Ge also had his ultimate mission, which was to fulfill the value of his life in the end, but he finally completed it. Many of us may not be able to truly fulfill the value of life in the end, and people themselves know that they are going to die, and only how they die. This is different from animals, so humans are also animals with a body and a tragic nature. Hu Ge also knew how he died, but he gritted his teeth and passed through each pass, and finally walked towards his own sacrifice, but in fact he obtained a life."


In the movie, the dilemma he sets for the protagonist is a strange space.


Speaking at a press conference in Cannes, he described the space as an inner heterotopia. Stepping into the edge of China’s reality and into these dark depths, Diao Yinan felt that the bright shadows at night, the lights, the steam, the shadows, the streets, and the silence all brought a sense of romance or destiny.



The characters of Hu Ge and Gui Lunmei are both gray people on the edge.


But Diao Yinan feels that the darker the person, the more light he can see. He tries to talk about some chivalrous concepts in this film. In his opinion, traditional ethics and morality are the more valuable qualities of this era: "Today’s society is developing very fast, and everyone has slowly forgotten these values of tradition, so I think it is particularly necessary to remind everyone that these things are very important."

 

It seems that not everyone has received this signal.


After the Cannes Film Festival ended, "The Wild Goose Lake" did not win a prize.


Diao Yinan, who once said that he liked to keep himself in a state of not being recognized, said this time: "You have to continue to climb up, the mountain is still there. And I think there are still many people who do not recognize me, and some people say that our movies are not good. I regard these opinions as wealth."

 

At the end of the movie, Diao Yinan felt that the ending he gave was warm: "The foundation of Hu Ge’s actions also has a warm tone. In the end, the two women completed their redemption and walked on the street, as if they had won victory."

 

I don’t know if it was because he was in a difficult situation and caught the ray of light.
